These terms and conditions outline the rules and regulations for the use of The Very Ting (Grenada) Ltd.’s website and mobile app’s marketplace platform (hereinafter referred to as the “TVT’s platform”), located at https://theveryting.com/. The website is owned and operated by the The Very Ting (Grenada) Ltd. incorporated under the Companies Act Cap. 58A of the Continuous Revised Edition of the Laws of Grenada. We recommend that you read these Terms & Conditions carefully in order to understand some of the rules of operations which govern The Very Ting (Grenada) Ltd., its customers, users, directors, staff and affiliates.
Throughout the website, namely the Terms and Conditions, Forum Rules, Listing Rules, Vendor Rules, Price List, Privacy Policy, Return Policy and Disclaimer Notice and all Agreements, the following terminology: “The Company”, “Ourselves”, “We”, “Us”, “Service(s)” and “Our” refer to The Very Ting (Grenada) Ltd., our website, our mobile app and our services, while the following terms: “Client”, “You”, “User”, “Your” refers to you, the person logged onto this website and compliant to the Company’s terms and conditions. “Party”, “Parties”, or “Us”, refers to both the User and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the User in the most appropriate manner for the express purpose of meeting the User’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Grenada. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.
The Very Ting (Grenada) Ltd. offers the TVT’s platform, including all information, tools and services available from our platform to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By accessing or signing-up on this website we assume you have read and accept these General Conditions of Use (hereinafter referred to as the “Terms and Conditions”), the Privacy Policy, as well as the other compulsory provisions of this website whether or not they are discussed in these Terms and Conditions inclusive of the Forum Rules, Listing Rules, Vendor Rules, Price List, Privacy Policy, Return Policy and Disclaimer Notice, accept them and undertake to comply with them. Do not continue to use theveryting.com or our mobile app if you do not agree to accept all of the terms and conditions stated on this page. By visiting our website and/or ordering something from one or several of our vendors, you engage in our “Service” and agree to be bound by the following terms and conditions “Terms of Service”, Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the website and our mobile app, including without limitation users who are browsers, vendors, customers, merchants, advertisers, and/or contributors of content.
Please thoroughly read these Terms and Conditions carefully before accessing or using TVT’s platform. By accessing or using any part of our website or mobile app, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access TVT’s platform or use any services. If these Terms and Conditions are considered an offer, acceptance is expressly limited to these Terms and Conditions.
Any new features or tools which are added to the current stores shall also be subject to the Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this web page. We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to TVT’s platform. It is your responsibility to check this web page periodically for changes. Your continued use of or access to TVT’s platform following the posting of any changes constitutes acceptance of those changes. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms and Conditions.
DEFINITIONS USED ON THE WEBSITE
Additional Service(s) – refers the additional payable services provided by The Very Ting (Grenada) Ltd. and offered on the website (as shown in the Price List), such as Very+ and Buyer Protection, which are not main services and which may be subject to separate conditions of use.
Buyer – refers to any User who receives via exchange/trade or donation or buys or wishes to buy one or more Item(s) listed on TVT’s platform. Clients who book appointments from service providers are not eligible to engage in any exchange/trade promoted or facilitated by TVT’s platform;
Very Protection – refers to the Additional Service proposed by The Very (Grenada )Ltd. where the Buyer will benefit from additional protections only if they use the Integrated Payment and Shipping Service, as detailed in section ……… below.
Listing – refers to the digital systematic list in which the same kind of listed item (refers to Goods or Services that are posted for sale, exchange or donation), it is being understood that all Users must comply with the rules of Listing items established by The Very Ting (Grenada) Ltd. . The rules of the Listings can be found here;
Collection Instructions – refer to the option for the pick-up of the Item or Items bought or exchanged or donated via TVT’s platform, where the collection services are provided by the Buyer or User as part of the Delivery Confirmation process;
Custom Shipping – refers to the option for the transportation and delivery of the Item or Items bought or exchanged or donated via TVT’s platform, where the transport and delivery services are provided by a shipping provider selected independently by the Seller;
Delivery Confirmation – refers to the confirmation that the Buyer or the User has received the Item or Items bought or exchanged or donated via TVT’s platform;
Forum – refers to the page of the website where Users may publicly communicate about a particular topic or subject. The rules applicable to the Forum are available here;
Integrated Booking Service – refers to the action or process of booking appointments for service items ordered from a vendor or service provider registered on TVT’s platform;
Integrated Collection Service – refers to the action or process of collecting items bought or exchanged or donated from a Seller or Vendor registered on TVT’s platform;
Integrated Payment and Shipping Service – refers to the Service consisting of the Integrated Payment Service and the Integrated Shipping Service, which is optional for the User, facilitating and securing the payment and delivery of an Item or Items listed on TVT’s platform when the Transaction consists of a sales contract;
Integrated Shipping Service – refers to the shipping and delivery Service paid for by the Buyer, enabling the Seller or Vendor to deliver the Item or have the Item or Items delivered to the Buyer as part of a sales contract, with the shipping, transport and delivery services being undertaken by one of the partners of The Very Ting (Grenada) Ltd. as detailed in the section ……… below;
Integrated Shipping (Veryed shipping labels) – refers to the option for the transportation and delivery of the Items bought or exchanged or donated on the Website, where the transport and delivery services are provided by one of the third-party shipping providers offered to select from by The Very Ting (Grenada) Ltd., and the Seller or Vendor must use Shipping labels generated on TVT’s platform as provided in the section ……… below;
Item or Items – refer to the goods or services whose sale or exchange or donation is not forbidden by national applicable law or prohibited by the Listing Rules, and that are listed by the User in TVT’s platform corresponding Listing category, in order to sell, exchange or donate them;
Main Services – refer to the option offered by The Very Ting (Grenada) Ltd. to Users and, when applicable, Visitors, to list the Items in the relevant Listing category, to examine the Items, to directly participate in donation or exchange or purchase-sale or other Transactions, to use the Integrated Payment and Shipping Services and to communicate in private and/or in public, particularly by using the Forum;
News – refer to content shared by The Very Ting (Grenada) Ltd., on the Website or Mobile app relating in particular to short and long-term offers, competitions or new Services published on TVT’s platform or through email notification;
Non-User – refers to any individual who has not created an account on TVT’s platform and has not accepted The Very Ting (Grenada) Ltd.’s Terms & Conditions. For the sake of clarity a Non-User in The Very Ting (Grenada) Ltd.’s Terms and Conditions, means an individual who is not a consumer and does not act as an individual to satisfy his/her personal requirements that can be associated with a professional or personal activity;
Price List – refers to the web page outlining the prices of The Very Ting (Grenada) Ltd.’s Additional Services;
Private Messages – refers to communication by an exchange of private messages between Users via TVT’s platform messaging feature, which can only be accessed by the Users concerned;
Privacy Policy – refers to the web page that defines the manner in which The Very Ting (Grenada) Ltd. collects, uses, stores and transfers personal data and other important information of a User or a Visitor;
New Order Confirmation – refers to the confirmation that the Buyer or the User has ordered the Item or Items;
Order Complete Confirmation – refers to the confirmation that Buyer’s or the User’s order or orders are marked completed and usually indicates that the order or orders have been shipped and or delivered or collected;
Seller/Vendor – refers to any User who lists one or more Item(s) in the relevant Listing catalogue of the Website, inclusive of users who provide a service;
Service– refer to all the services offered by TVT’s platform, including the Main Services and the Additional Services;
Shipping Instructions – refers to the option for the transportation and delivery of the Item or Items bought or exchanged or donated on TVT’s platform, where the transport and delivery services are provided by one of the instruction shipping providers, and the Seller or Vendor must follow the shipping instructions as provided in Section ……… below;
Social networks Accounts – refers to The Very Ting (Grenada) Ltd.’s accounts on Google Business, Facebook, Instagram, YouTube and other social networks where information is provided about the Website and the Services it offers, sharing the contents published by Users;
Seller’s Store – refers to the online Seller Account assigned to a User who has registered as a Seller or Vendor. This feature allows Sellers or Vendors to manage inventory, view, complete or cancel orders and edit their item listing.
Website – refers to The Very Ting (Grenada) Ltd.’s website (https://theveryting.com/), as well as the mobile applications of The Very Ting (Grenada) Ltd.’s platform downloaded on smartphones or tablets;
Terms – these Terms and Conditions and all policies and additional terms posted on and in TVT’s platform, set out the terms on which The Very Ting (Grenada) Ltd. offers Users and Visitors access to and use of The Very Ting (Grenada) Ltd.’s Services;
Transaction – refers to all the transactions, which transfer the ownership of and/or the right to use an Item or Items from one User to another, including but not limited to, the sales contract concluded directly between the Buyer and the Seller, or the exchange or any other transaction carried out between Users;
User – refers to any individual who has created an account on TVT’s platform and has accepted The Very Ting (Grenada) Ltd.’s Terms & Conditions. For the sake of clarity, a User in The Very Ting (Grenada) Ltd.’s Terms and Conditions, means an individual who is a consumer and acts as an individual to satisfy his/her personal requirements that can be associated with a professional or personal activity;
User account or Account – refers to the User’s account created upon registration on TVT’s platform; the created account contains personal as well as financial information;
Veryfied – refers to a status associated with any User who has signed up to have their Item or Items vetted by The Very Ting (Grenada) Ltd.;
Visitor – refers to any individual not signed-up on TVT’s platform, but likely to use TVT’s platform without being registered, in accordance with the Terms and Conditions.
SECTION 1 – ONLINE STORE TERMS
By agreeing to these Terms and Conditions, you represent that you are at least the age of majority and you have given us your consent to allow of your minor dependents to use this website.
You may not use our website for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your use of our website. The Company reserves the right to co-operate with law enforcement on investigations involving the activities of any user suspected or accused of conducting illegal activities via our website.
SECTION 2 – GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including debit or credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Debit or Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on TVT’s platform through which the service is provided, without expressed written permission by us.
SECTION 3 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not responsible if information made available on TVT’s platform is not accurate, complete or current (excluding the Terms and Conditions web page). The material on TVT’s platform is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on TVT’s platform is at your own risk.
This site may contain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site and our mobile app at any time, but we have no obligation to update any information on TVT’s platform. You agree that it is your responsibility to monitor changes to TVT’s platform website.
SECTION 4 – MODIFICATIONS TO THE SERVICE AND PRICES
Prices to our products and the goods and services listed by our vendors are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without any notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
SECTION 5 – MAIN SERVICES
5.1 The Very Ting (Grenada) Ltd. is an online intermediary hosting service and offers Services in facilitating Transactions, a virtual exchange forum, namely the E-commerce Website, a systematized List of items and a Forum. Users can list their Item or Items in the appropriate Listing category on TVT’s platform to exchange, buy or sell an Item or Items, use the Integrated Payment and Shipping or Collection Service, communicate by sending Private Messages to other Users, communicate on the Forum and use other Additional Services offered by TVT’s platform. The Very Ting (Grenada) Ltd. is not party to any Transaction between Users. Under no circumstances will The Very Ting (Grenada) Ltd. buy, sell or exchange Items shown on the Website nor claim to do so.
5.2 Subject to the Terms indicated on TVT’s platform, Users may purchase chargeable Additional Services on the Website (to the prices indicated in the Price List and during checkout).
5.3 These Terms and Conditions, the Privacy Policy and the other regulations published on The Very Ting (Grenada) Ltd.’s Website and mobile app apply to the Users and Visitors of The Very Ting (Grenada) Ltd.’s Social Network Accounts too, which must comply with them.
SECTION 6 – GOODS OR SERVICES
Certain goods or services may be available exclusively online through TVT’s platform. These goods or services may have limited quantities and are subject to return or exchange only according to our Return Policy. It is the Vendors’ responsibility to ensure every effort is made to display as accurately as possible the colours and images of their goods and other types of listings that appear at their store. We cannot guarantee that your device’s screen display of colour or resolution will be accurate.
We reserve the right, but are not obligated, to limit the sales of our Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any goods or services that we may offer and extend said right to our vendors. All descriptions of goods and services or their pricing are subject to change at anytime with notice, but at the sole discretion of us. We reserve the right to discontinue our products or any vendor’s product offering at any time. Any offer for any good(s) or service(s) made on TVT’s platform is void where prohibited. We do not warrant that the quality of any goods, services, information or other material ordered, purchased or obtained by you will meet your expectations, or that any errors in the Service will always be corrected.
SECTION 7 – LISTING ITEMS
7.1 To list an Item on TVT’s platform, the requirements set in this section and the following conditions must be fulfilled:
- Only goods and services stipulated in the Listing Rules may be listed on the Website;
- The Seller or Vendor must ensure that his/her Item or Items comply with the Listing Rules. Some categories of items cannot be uploaded.
- The Seller or Vendor must be the owner of the Item or Items listed on their Seller’s Store and have the right to transfer the ownership of, sell, exchange or donate the Item or Items listed.
- The sale, exchange, use or possession of such Items must not violate the rights of any third party, must comply with intellectual property rights and must not violate any local, national or international applicable law or regulation and must be safe and cannot be a counterfeit.
- The Item must comply with the commonly applied requirements on the market for this type of Item depending on the nature of the Transaction, unless there is an agreement to the contrary between the Buyer and Seller.
7.3 The Item listed in the Catalogue must not only be described in the sign-up form regarding the listing of the Item, but must also be properly photographed. At least two good quality photographs must be uploaded when the Item is listed (the use of photographs found on the Internet and/or photos of a similar item is forbidden). It must reflect the actual quality and external appearance of the Item, as well as any presence of faults with the Item inclusive of signs of aging or wear and tear.
7.4 The quantity of Items listed in the Listing Catalogue on the Website is unlimited. The listing of the same Item more than once in the Listing Catalogue of the Website in any given 12 month period is forbidden.
7.5 The Seller or Vendor who has listed the Item may withdraw it or amend the price at any time, before entering into contact with a User for the sale or exchange or donation of the Item or Items in question.
7.6 The Seller or Vendor is responsible for managing the online inventory associated with each listing and must update the Seller’s Store inventory to reflect any exchange of an Item or Items by using the ‘Trade‘ function or purchase of an Item or Items through the Website or mobile app directly via the Integrated Payment System offered by The Very Ting (Grenada) Ltd. by using the “Add to Basket” or “Buy now” button where Buyer Protection Services fees apply automatically and compulsorily.
SECTION 8 – SALE OF ITEMS AND PRICES FOR ADDITIONAL SERVICES
8.1 The Buyer may choose to obtain an Item in three ways (1) buying or donating item(s) through the Website directly via the Integrated Payment System offered by The Very Ting Grenada Ltd. using the “Add to Basket” or “Buy Now” button where Buyer Protection Services fees apply automatically and compulsorily, (2) exchanging Items by using the ‘Trade’ function or (3) a direct transaction between Users, Users and Non-Users, Users and Visitors, Visitors and Non-Users or Non-Users. In the latter case, the Buyer and the Seller are solely responsible for the sale, arrangement for organisation and consequences of the shipping, delivery or collection of the Item and cannot use the assistance provided by The Very Ting Grenada Ltd. in this context.
For the purpose of the Additional Services, the User or Visitor must provide his/her bank/credit union details so that the proceeds of the sales completed on TVT’s platform may be transferred to his/her personal or business bank/credit union account. If a bank/credit union account or card belonging to a third person (i.e. a User who sells on behalf of the owner of the item or service listed) is registered on TVT’s platform, the Very Ting Grenada’s Team may request proof of identity. Additional services will trigger costs to be paid by the User, the amounts of which are indicated in the Price List.
8.2 As per 8.1, Users may also exchange Items between each other. Users can indicate that they wish to exchange items by using the “Trade” function between themselves via TVT’s platform by marking the listed Item as ‘available for trading’. It is up to the Users to decide how they want to complete the exchange, they may either (1) decide to do it via the Integrated Payment and Shipping Service or (2) directly agree on how to arrange for payment, shipping and any other dealings regarding the Item they want to exchange (i.e. without using the Integrated Payment and Shipping Service). Note: the trading function is not yet available for services, all booked services must be paid for via the Integrated Payment Service. In the latter case, the Buyer and the Seller are solely responsible for the sale, arrangement for organisation and consequences of the shipping, delivery or collection of the Item and cannot use the assistance provided by The Very Ting Grenada Ltd. in this context.
8.3 When an Item for sale in the Listing Catalogue in accordance with section 7 and as such is published to other Users, this constitutes an offer for sale, trade or donation of the relevant item by the Seller or Vendor, which may be accepted by a Buyer or Trading partner.
8.4 In the event that the Transaction is a sale, the Integrated Payment and Booking, Collection or Shipping Service is automatically offered to the Buyer. If the Buyer chooses the Integrated Payment, Integrated Booking, Collection or Shipping Service, Buyer Protection fees compulsorily apply to the Transaction. In addition, the Buyer accepts the Seller’s or Vendor’s offer when he/she clicks on “Place order” on the Checkout page. If the Buyer does not use the Integrated Payment, or Integrated Booking or Collection or Shipping Service, the offer and acceptance of offer is agreed independently between the Seller and Buyer. The Buyer acknowledges that his/her acceptance of the offer has been made in consideration of the description of the Item, which is the subject of the sale. Both the Buyer and the Seller or Vendor acknowledge that:
1. A legally binding contract is created between the Buyer and the Seller for the purchase of goods “the Sales Contract”;
2. that it represents a firm commitment by each party to this contract to perform the contract with the Seller or Vendor under the conditions of the offer; and
3. For the avoidance of doubt; The Very Ting (Grenada) Ltd. is not a party to this sales agreement.
8.5 The Seller or Vendor may decide to purchase Additional Services to improve the visibility of their Items. Details of the existing Item promotion Services are provided in the Price List.
SECTION 9 – THE VERY PROTECTION SERVICES
9.1 The Very Protection Service automatically and compulsorily applies to the Transaction when the Buyer uses the Integrated Payment Service and Integrated Booking or Integrated Collection or Integrated Shipping Service. This is not applicable if the Buyer and the Seller agree to finalise the Transaction outside of TVT’s platform. If the Buyer decides to use the Integrated Payment Service, the Seller has to comply with it. The Integrated Payment Service is only available to Users from some countries and/or regions, and Booking or Collection or Shipping Services are available only to residents of Grenada. If the Service is unavailable, the Seller and the Buyer must agree on one of the methods for their Transaction as identified in section 8.1.
If the Buyer decides that the Transaction will be carried out without Integrated Payment and Integrated Booking or Integrated Collection or Integrated Shipping services, then The Very Ting (Grenada) Ltd.’s Very Protection Services will not be available too. In this case the Buyer and the Seller are solely responsible for the organisation and consequences of the shipping of the Item and cannot use the assistance provided by The Very Ting (Grenada) Ltd. in this context.
9.2 The “Very Protection” Service includes services where the buyer will benefit from the “Very Protection” described in Article 9.5 below and may be entitled to a refund if the requirements for Very Protection refunds are met. The Very Protection Services are not insurance services or legal protection guarantee services.
9.3 Buyers who benefit from the Very Protection Services will be charged the corresponding fee, as provided for in Article 9.4. Payments will then be made through the Integrated Payment Service and delivery via the Integrated Booking or Integrated Collection or Integrated Shipping Service, if these services are available in the Buyer’s parish.
9.4 Very Protection Fee. The Very Protection Services facilitate and secure the Transaction on the Integrated Payment Service. The Very Ting (Grenada) Ltd. thus collects respective fees for such services. In order to benefit from the Very Protection Services, for each Transaction, Buyers are charged a fee on top of the purchase price of the Item. The total amount of such fee is shown to the Buyer on the Website before completion of the order and is calculated in accordance with the Price List. The payment of the Very Protection Services fee also allows the Buyer to benefit from the advantages mentioned in Article 9.5 below.
9.5 Services included in the “Very Protection”:
9.5.1 If the Buyer uses the Integrated Payment and Integrated Booking or Integrated Collection or Integrated Shipping Service, he/she will benefit from the Additional Service of Very Protection which is an integral and mandatory part of Integrated Payment and Integrated Booking or Integrated Collection or Integrated Shipping Services. Very Protection Service includes reimbursement should the following conditions be met:
9.5.2 If the Item did not substantially comply with the description provided by the Seller or Vendor, or if the Item has been damaged during shipment, the Buyer has two (2) calendar days, starting from the date of the delivery of the Item, to inform The Very Ting (Grenada) Ltd. by emailing hello@theveryting.com, subject line “Dispute Filing” including a description of their dispute, date and time, order number, description of item or items, genuine images or video to support their position. This will suspend the Transaction and The Very Ting (Grenada) Ltd. will retain the Total Purchase Price. once the Very Ting (Grenada) Ltd. suspends the transaction, the process is as follows:
1. As a first step, the Buyer and Seller have the right and chance to resolve the situation themselves and inform The Very Ting Ltd. about their joint decision by emailing hello@theveryting.com. In this case, The Very Ting Ltd. commits to follow such a decision and reimburse the Buyer or the Seller as agreed from the amount retained in the escrow account.
2. Only if the Buyer and the Seller do not reach an agreement directly, or they do not want to settle the situation directly, the Buyer or the Seller can escalate the issue to The Very Ting (Grenada) Ltd. and provide the latter with evidence (e.g. photos, videos, documentation, etc.) to support their position. After The Very Ting (Grenada) Ltd. has reviewed the situation and in case The Very Ting (Grenada) Ltd. considers that the Item indeed does not substantially comply with the description provided by the Seller, The Very Ting (Grenada) Ltd. will cancel the Transaction by informing the third party financial service provider operating the escrow account to reimburse the Buyer after said Item has been returned to the Seller via Collection by the Seller or Shipment facilitated by the Buyer. The Buyer will be reimbursed of the total purchase price. Please note that The Very Ting (Grenada) Ltd. does not provide return shipping services and that the Buyer has to return the Item to the Seller within the period stipulated by The Very Ting (Grenada) Ltd., after the Seller provides a return address or the Buyer returns the item, unless otherwise agreed with the Seller. If the Buyer does not return the Item to the Seller within the period stipulated by The Very Ting (Grenada) Ltd., the Buyer may not be eligible to receive a refund under the Very Protection service. The Very Ting (Grenada) Ltd. will inform both parties via email or SMS of the stipulated period for return of the item(s). See our Return Policy for more.
If there are strong indications that the received item is a counterfeit, the Buyer may not be required by The Very Ting (Grenada) Ltd. to return the item in order to get a refund, but this is decided by The Very Ting (Grenada) Ltd. on a case-by-case basis, following information provided by the Buyer and the Seller and they commit to respect such decision by The Very Ting (Grenada) Ltd.
9.5.3 If the Buyer did not receive an Item, the Buyer must inform The Very Ting (Grenada) Ltd. by reporting the issue by emailing hello@theveryting.com, subject line: “Order not received”, within a period of two (2) calendar days after receipt of a Delivery Confirmation email where the Item is marked as “delivered”. If the Item is confirmed as lost during shipping, after investigations by The Very Ting (Grenada) Ltd. the Buyer may be reimbursed by the third party financial service provider operating the escrow account of the total purchase price.
9.5.4 If there is something wrong with the item or Item was not received (as described in 9.5.2 or 9.5.3), but the Buyer does not contact The Very Ting (Grenada) Ltd. within two (2) calendar days (i.e. the Dispute filing Period) as stipulated in sections 9.5.2 or 9.5.3, or simply confirm that the received Item was accepted (during this 2-day term), the Transaction is then completed and the Very Protection service ends. In this case, the Buyer will not be entitled to any reimbursement.
9.5.5 In the case where the Item complies with the description provided by the Seller, the Buyer shall not be eligible to ask for reimbursement and The Very Ting (Grenada) Ltd. will mark the Transaction as complete. After the Transaction is completed and the money on escrow is released to the Seller, the Buyer can try to negotiate directly with the Seller the return of the Item (e.g. agreement or reimbursement, return shipping fees, etc). Please note that in such case, the Seller may also refuse to cooperate with the Buyer on the grounds that the Transaction has been fulfilled from the Seller’s side. The Very Ting (Grenada) Ltd. will not be responsible or part of the transaction after it has been marked as complete.
9.6 IF THE BUYER DID NOT USE THE INTEGRATED PAYMENT SERVICE AND DID NOT PAY THE VERY PROTECTION SERVICE FEE:
9.6.1 In this case, The Very Ting (Grenada) Ltd. does not guarantee the safety of the payments being made. The Very Ting (Grenada) Ltd. does not provide assistance to the Buyer or the Seller if the Buyer does not use the Very Protection Services. The Buyer and Seller are alone responsible for the proper implementation of the Transaction and should negotiate all of the Transaction details themselves directly (e.g. payment conditions, shipping, conditions to return the Item, lost item, etc.).
9.6.6.2 In case of misconduct by either the Buyer or the Seller reported or observed by to The Very Ting (Grenada) Ltd., The Very Ting (Grenada) Ltd. may provide assistance to the affected party. The Very Ting (Grenada) Ltd. will also cooperate with local authorities if required.
SECTION 10 – INTEGRATED PAYMENT SERVICE
10.1 As part of the Integrated Payment Service, the Buyer must pay in advance for the Item(s) purchased from the Seller by credit or debit card, bank transfer, or any other payment method that may be introduced by The Very Ting (Grenada) Ltd. from time to time, by using the Integrated Payment Service available on TVT’s platform.
10.2 The amounts paid by the Buyer (Item price, the Very Protection service Fee, Shipping Fees, together the “Total Purchase Price”) will be retained by a financial service provider selected by The Very Ting (Grenada) Ltd. (……….) in an e-wallet operating as an escrow account up until the transaction is completed. The transaction is deemed completed:
(i) when the Buyer confirms through the platform that the delivered Item(s) complies with the conditions of the offer by clicking “All is well”; or
(ii) automatically after the expiration of the 2 Calendar day Dispute Filing Period defined in section 9.5.2 if no disputes about the Item(s) are raised; or
(iii) If a dispute is raised during the Dispute Filing Period, after the resolution of the dispute.
Once the transaction is completed, the purchasing price will be immediately transferred to the Seller’s e-wallet. The funds available on the User’s e-wallet can be transferred at any time to his/her personal bank account provided that this information was accurately submitted at the time of registration, without any transfer fee and for any amount whatsoever.
10.3 The Very Ting (Grenada) Ltd. relies on …………… to process the payment and store the information regarding the credit or debit card, in order to be able to use the Integrated Payment Service, the Buyer declares that he/she accepts the general conditions of this provider. The Buyer will be solely responsible for the transmission of information associated with the credit or debit card and The Very Ting (Grenada) Ltd. hereby denies any responsibility to the full extent permitted by the applicable legislation.
10.4 Please note that the right to use the Integrated Payment Service is only for sales in a User’s own name. A User may not resell their user account or on any other basis allow third parties to use the Integrated Payment Service to enable such third parties to be paid for their services. Users may not use the Integrated Payment Service for types of product and services other than those registered with TVT’s platform. If The Very Ting (Grenada) Ltd. at any time discovers that the information a User provided about himself/herself is incorrect or has changed without informing The Very Ting (Grenada) Ltd. via updating their User account on TVT’s platform or if a User violates any of these conditions, the Services may be suspended and/or terminated with immediate effect, with notice via email. In particular, the User confirms that she/he will not use the Integrated Payment Service for any type of product or service not appearing in the Listing Rules.
10.5 If any suspicion arises about fraud of any kind whatsoever, carried out by a User, The Very Ting (Grenada) Ltd. will immediately suspend the account of the User in question as well as the transactions under way while waiting for the results of the enquiry being conducted by the Very Team or any third party appointed by The Very Ting (Grenada) Ltd..
10.6 In the event of any problem (such as hints of suspected illegal sales or donations or trading on TVT’s platform, money laundering, spamming, violation of The Very Ting (Grenada) Ltd.’s terms and conditions, violation of the payment providers terms and conditions) reported by the provider responsible for the Integrated Payment Service to The Very Ting (Grenada) Ltd., The Very Ting (Grenada) Ltd. may immediately suspend the Account of the User in question as well as the transactions under way while waiting for the results of the enquiry being conducted.
10.7 The Very Ting (Grenada) Ltd. reserves the right to suspend a User’s Account if a User in relation to a Transaction initiates a dispute resolution procedure via an external payment service provider and, in consideration of all circumstances of the initiated dispute resolution procedure, The Very Ting (Grenada) Ltd. has a legitimate reason to suspend the User’s Account (e.g. in case of breach of applicable laws and/or of these Terms and Conditions and/or there is a likelihood of misuse of TVT’s platform).
SECTION 11 – INTEGRATED COLLECTION, BOOKING OR SHIPPING SERVICE
11.1 Shipping Options. The Very Ting (Grenada) Ltd. does not provide carrier services. Available shipping options are: Integrated Shipping (Pre-Paid Labels), Shipping Instructions, or Custom Shipping options (as further described in Sections 11.1.1, 11.1.2 and 11.1.3 below). Users are responsible for reviewing and agreeing with the terms and conditions of the third-party shipping provider that they select as specified below, whether they are acting as Sellers or as Buyers. The Buyer will pay for shipping at Checkout and the shipping fee will be held in The Very Ting (Grenada) Ltd.’s e-wallet in escrow.
11.1.1. Integrated Shipping (Pre-paid Labels). Users may see the list of available shipping providers on the Shipping Providers Policy page. The Very Ting Ltd. may, at any time, add or remove shipping providers from the list of choices available to Users. The list of Integrated Shipping Providers, as well as the terms and conditions of each of these providers (including possible limits of carrier compensation), are accessible at any time for the Buyers and Sellers here. During Checkout, the Buyer will be able to choose from the shipping providers selected by the Seller. After Checkout, an automatically generated pre-paid shipping label will be provided to the Seller via a “New Order Confirmation” email and must be used to send the Item to the Buyer, otherwise the Transaction will be cancelled. Once the Transaction is completed (as per Section 10.2), the price of the Item(s) will be released from Escrow to the Seller and the Very Protection fee and the fee for shipping (including any applicable VAT on Services) will be released from escrow to The Very Ting Ltd.
If an Item(s) is lost or damaged during the shipping process, the Buyer is eligible for a refund as part of Very Protection, as described in Section 9.5 (Services included in the “Very Protection”:). The Seller may be entitled to compensation for a lost or damaged item(s) up to the compensation limit set by ……., in accordance with the Shipment Policy. The Seller’s compensation will be borne and handled by The Very Ting Ltd. and has to follow procedures outlined in the Shipment Policy. The Seller will always be able to access the terms and conditions each Shipment Provider must agree to and follow on the Shipment Policy page. When the Seller lists an item(s) in the Catalogue, it is the Seller’s responsibility to review the terms and conditions of the Shipment Policy that applies to Shipment Providers who may be selected for the delivery of that Item. By listing an Item, the Seller confirms that he or she accepts the selected Shipment Provider’s terms and conditions to which he or she has had access.
Integrated Shipping (Pre-paid Labels) is available in Mainland Grenada.
11.1.2. Shipping Instructions. Users may see the list of available shipping providers on the Shipping Providers Policy page. The Very Ting Ltd. may, at any time, add or remove shipping providers from the list of choices available to Users on the Shipment Providers page. The list of shipping providers, as well as the Shipment Policy are accessible at any time here for the Buyers and here for the Sellers. After Checkout, the Seller must purchase the shipping service and label according to the provided shipping instructions and send the Item to the Buyer using one of the Shipment Providers listed on our Shipment Providers page. Once the Transaction is completed (as per Section 10.2), the price of the Item(s) and the shipping fee will be released from escrow to the Seller and the Buyer Protection fee (including any applicable VAT on Services) will be released from escrow to The Very Ting Ltd. If an Item(s) is lost or damaged during the shipping process, the Buyer is eligible for a refund as part of Very Protection as described in Section 9.5 (Services included in the “Very Protection”:).
11.1.3 Custom Shipping. If the Seller decides to ship an Item(s) without using Integrated Shipping (Pre-paid Labels), the Seller will be solely responsible for choosing the shipping provider, determining the postage price, and arranging for the label and shipping the Item(s). The Seller is responsible for estimating a correct and accurate price of postage or delivery and identifying it in the listing. The Seller must use a shipping provider with tracking enabled and send the parcel tracking number to (i) The Very Ting Ltd. via email to hello@theveryting.com, subject line: Tracking details. will indicate, and (ii) the Buyer via a Private Message on the Website.
If any Item(s) that is sent by Custom Shipping is lost or damaged in the shipping process:
(i) Under the Very Protection, the Buyer will be eligible for a refund under the conditions set out in Section 9.5.2 (Services included in the “Very Protection”).
(ii) The Very Ting Ltd. will not offer any compensation to the Seller and the Seller will have to reach out to the Shipping Provider directly regarding any problems in connection with shipping. The Seller therefore should consider insuring Items shipped using a Custom Shipping Option in the event the Item is lost or damaged.
11.2 Payment of the Shipping Fees. The Shipping Fees are paid by the Buyer, in addition to the Item price and the Very Protection fee. The applicable shipping fees will be clearly indicated to the Buyer before any purchase. They may vary from one order to the other, depending on factors such as parcel size, shipping route, shipping carrier and potential discounts.
11.3 Commitment to Ship. As soon as the Total Price has been paid by the Buyer, The Very Ting Ltd. will inform the Seller that they must ship the Item to the Buyer within three (3) working days. If the Seller does not ship the Item within this period, The Very Ting Ltd. can cancel the Transaction and direct PAYONEER to release the Total Price held in Escrow to the Buyer. The foregoing is without prejudice to any claim that the Buyer may have against the Seller, under applicable laws, for having failed to deliver the Item or late delivery.

SECTION 12 – PAYMENT
14.1 The Very Ting Ltd. Is authorised to collect sums as part of the Services provided in accordance with the prices indicated in the Price List.
14.2 All prices are expressed in Eastern Caribbean Dollar (XCD), all applicable taxes included.
14.3 In the event that a Transaction is carried out with the Integrated Payment and Shipping Service, the Buyer’s payment will be made by a credit card, debit card, bank transfer, or any other payment method approved for the Integrated Payment Service on the Website at the moment of concluding the Sales Contract in question. If the Buyer decides to use the Integrated Payment Service, the payment will be made by direct debit, bank card (Visa/MasterCard), virtual card or any other payment method on which the Users in question have agreed upon between themselves without the assistance of The Very Ting Ltd..
14.4 In the event of a Transaction being carried out with the Integrated Payment and Shipping Service, the total amount will be debited from the Buyer’s account (price of the Item, shipping costs and Very Protection Fees) and the Seller will collect the amount due to him/her only upon Receipt Confirmation. If the Buyer does not receive the Item or the Item did not substantially comply with the description provided by the Seller, and under the further conditions stipulated in sections 9.5.2 and 9.5.3 his/her account will be re-credited.
14.5 In the event of a Transaction being carried out without the Integrated Payment and Shipping Service, the Buyer and Seller need to agree on the conditions of payment as described in the sections above. The Very Ting Ltd. collects no fee in context with the Transaction in this case.
SECTION 13 – ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place via our platform. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same payment information inclusive of credit or debit card, and/orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the -mail and/or billing phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment appear to placed by dealers, resellers or distributors.

Using algorithms, The Very Ting Ltd. uses automated software to enable it to detect contents of Private Messages contrary to good moral standards and public order, those that are inappropriate, insulting or defamatory and sent by a user via Private Messages. Should a Private Message containing such contents be detected by the automated software, the Private Message and User may be, without limiting other remedies, automatically blocked in accordance with section 13 (Rights and Obligations of The Very Ting Ltd.) below and/or hidden, will be warned of his/her obligation to comply with the Terms and Conditions and informed that The Very Ting Ltd. may take further steps such as suspending the User’s Account in case of renewed violations.
The Very Ting Ltd. never has access to the content of Private Messages, including those that are blocked and/or hidden by the automated software. A User has the right to write feedback on another User solely if a Transaction was carried out between them. No compensation is given to users or to The Very Ting Ltd. in exchange for their online reviews. A User’s feedback on another User must always be fair and honest. Lies and insults are forbidden.
The Very Ting Ltd. does not review feedback prior to publication by Users. 16.2 In no case shall The Very Ting Ltd., our subsidiaries, directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licencors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, lost business opportunity, goodwill or reputation, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of our Service(s) or any product procured using our Service(s), or for any other claim related in any way to your use of the Service(s) or any product, including , but not limited to, any errors or omissions in any content, or nay loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
16.3 The Very Ting Ltd. provides an online platform to introduce individuals to one another to enable the purchase, booking, exchange and donation of items between them and to allow them to communicate with one another in public through a forum and comments section and in private through direct messaging on the platform. Buyers and Sellers and parties to an exchange or donation are solely responsible for Transactions entered into using the Website.
16.4 The Very Ting Ltd. are not responsible for any action or inaction of users of the Website or Services, or content provided by Users of the Site including, without limitation:
1. the descriptions or photos of Items, including their accuracy and completeness;
2. the quality, legality or safety of the Items;
3. the Seller’s or vendor’s, exchanger’s or donor’s title to the Items; or
4. any Seller’s or Vendor’s or Buyer’s right to enter into a sale or the rights of the parties to an exchange or give-away to enter into such Transaction.
16.5 Subject to section 16.2, The Very Ting Ltd. will not be liable for any loss or damage caused by a virus, distributed denial-of-service attach, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website or Services, or to your downloading of any content on it, or on any Website linked to it.
16.6 The Very Ting Ltd., are not responsible for any third party service providers that you integrate into your account. The Very Ting Ltd. will not be liable for any loss or damage that may arise from your use of them.
16.7 Subject to section 16.2, The Very Ting Ltd., its subsidiaries and affiliated group organisations limit liability under this Agreement, whether such liability arises in contract, tort (including without limitation negligence) or otherwise, to a maximum of:
1. the purchase price paid or payable for the relevant item in respect of any claim arising in relation to a transaction on this Website; or
2. up to $100 XCD in respect o any other claim.
16.8 The Very Ting Ltd. shall not be in breach of these Terms nor liable for delay in performing, or failure to perform any obligations under these Terms agreement if such delay or failure result from events, circumstances or causes beyond our reasonable control. In such circumstances The Very Ting Ltd. shall be entitled to a reasonable extension of the time for performing any such obligations under these Terms and Conditions.
16.9 All Users are fully liable for any information they post on the Website as well as for the Items they offer, sell or transfer to other Users. Without limiting the foregoing, Users acknowledge and accept that they are fully responsible for uploading any Item in the Catalogue, as well for the Item description, photographs and videos, for any information posted on the Site and declarations made to Buyers or other Users and for the accuracy of the other details provided (including Private Messages, feedbacks and Forum postings) (hereinafter together referred to as the “Content”). In addition, Users are solely responsible for the Transactions undertaken with other Users and disputes that could result from them, save in cases where disputes are caused by The Very Ting (Grenada) Ltd.’s failure to comply with its obligations under these Terms.
17.0 Users must comply with all laws, rules and regulations that are applicable to them when using the Website. Users must in particular refrain from (i) infringing the rights of third parties, (ii) infringing intellectual property rights or listing counterfeit Items, (iii) listing Items that violate laws or regulations; (iv) inciting offences or crimes, discrimination, hate or violence based on race, ethnic origin or nationality, (v) communicating incorrect information or confidential information, (vi) making defamatory comments, (vii) committing actions that might place minors in danger, (viii) publishing the personal data of other individuals or breaching privacy rights or (ix) misappropriating someone else’s identity; or (x) uploading or otherwise inputting any Content that is unlawful, false, or inaccurate. Users must act and use the Website in good faith.
10.2 Users must comply with all laws, rules and regulations that are applicable to them when using the Site. Users must in particular refrain from (i) infringing the rights of third parties, (ii) infringing intellectual property rights or listing counterfeit Items, (iii) listing Items that violate laws or regulations; (iv) inciting offences or crimes, discrimination, hate or violence based on race, ethnic origin or nationality, (v) communicating incorrect information or confidential information, (vi) making defamatory comments, (vii) committing actions that might place minors in danger, (viii) publishing the personal data of other individuals or breaching privacy rights or (ix) misappropriating someone else’s identity; or (x) uploading or otherwise inputting any Content that is unlawful, false, or inaccurate. Users must act and use the Site in good faith.
10.3 VINTED acts as a mere intermediary between Buyers and Sellers. If any User or Visitor reports any misconduct of another User or Visitor to VINTED, VINTED may provide assistance to the affected party. VINTED will also cooperate with local authorities if required. In the event that a User does not comply with Section 11 or otherwise violates these Terms, the User recognises and accepts that he/she is solely responsible for any and all resulting direct and indirect losses of third parties or VINTED, when permitted by law. Consequently, the User recognises and accepts that to the extent permitted by applicable law, and save for cases of breach of these Terms, VINTED will under no circumstances be held responsible for any damages or losses suffered by Visitors or Users and/or third parties. In particular, without this list being exhaustive, VINTED will not be held responsible for: (i) actions or omissions of Users, (ii) the appropriateness, accuracy, exhaustiveness, and/or legality of any Content; (iii) the safety, quality, and quantity of Items that Users sell or buy via the Site, nor the conformance of an Item with the description given, (iv) any issue with the Transactions, except where expressly stipulated under the Buyer Protection.
10.4 VINTED is not responsible for the Content generated by Users. Users are responsible for their Content. Users acknowledge and accept that, in its capacity as a hosting provider, VINTED has no contractual duty to undertake any verification of the Content and the Items listed in the Catalogue, and, to the extent permitted by applicable law, will under no circumstances be held responsible for any damages or losses suffered by Visitors or Users and/or third parties in respect to these Content and Items. In accordance with its legal obligations, VINTED will remove from the Site any unlawful Content that has been duly reported to it, in a sufficiently detailed and clear way. If VINTED detects Content or Item that violate, or are likely to violate, applicable laws and/or these Terms, VINTED takes action against the User, as provided for in Sections 3.6 and 12.
10.5 If any User or Visitor discovers Content condoning crimes against humanity, inciting racial hatred and/or violence, and/or terrorist acts, concerning child pornography or any other unlawful content, VINTED must be informed immediately either by:
- applying the reporting procedure described here;
- contacting VINTED via the contact form;
- sending an email to the address legal@vinted.co.uk;
- sending a letter outlining the underlying facts in detail to the following address: VINTED UAB, Švitrigailos g. 13, LT-03228 Vilnius, Lithuania.
If such Content is reported, VINTED reserves the right, to suspend immediately, without notice, the account of the User (including any in-progress Transactions) and remove the Content, as provided for in Section 12.
10.6 If a User believes that any Content might violate these Terms and/or their rights and/or the rights of a third party (e.g. counterfeiting, insult, breach of privacy rights, product safety issue), the Users may notify this to VINTED either by:
- applying the reporting procedure described here;
- contacting VINTED via the contact form;
- sending an email to the address legal@vinted.co.uk;
- sending a letter outlining the underlying facts in detail to the following address: VINTED UAB, Švitrigailos g. 13, LT-03228 Vilnius, Lithuania.
10.7 Intellectual property rights holders shall submit a notice of intellectual property rights infringement by filling out the form available here.
10.8 If there is a product safety issue with an Item, Users are advised to stop using the Item.
10.9 VINTED is not responsible for any tax liabilities or reporting obligations that might arise to Users from their activities within the Site. For the purpose of the Transactions undertaken on the Site, the Users themselves are solely responsible for any taxation reporting duties, if any would arise under applicable legislation.
10.10 In compliance with applicable laws and regulations, VINTED takes all appropriate measures to protect the security of the data provided by Users and to prevent our Services from compromising the data and software stored on User’s computers, tablets or smartphones. However, even when VINTED has taken appropriate measures consistent with legal requirements, its systems may still be compromised by unpredictable events such as cyber attacks or security breaches regarding the transmission of data or affecting the volume and speed of data transmissions. In these conditions, we strongly suggest that Users take all appropriate measures to protect their own data and/or software, particularly from contamination by any viruses circulating on the Internet.
SECTION 17 – RESPONSIBILITY
17.1 All Visitors and Users are fully responsible, in their capacities as editors, for all the information they post on the Website and, if applicable, for the Items they offer, sell, exchange or transfer to other Users. In particular, when a User lists Items in the corresponding Catalogue, the User recognises and accepts that he/she is fully responsible for uploading the Item in the corresponding Catalogue, its description, confirmations, the accuracy of the other details provided and communication with other Users (including Private Messages and feedback) and, in general, the Transactions undertaken with other users and disputes that could result from them (hereinafter together referred to as the “Content“).
17.2 In this respect, Visitors and Users must respect all the applicable regulations. Users and Visitors must in particular refrain from (i) violating the rights of third parties, (ii) violating intellectual property rights or listing counterfeit items, (iii) inciting offences or crimes, discrimination, hate or violence based on race, ethnic origin or nationality, (iv) communicating incorrect information or confidential information, (v) making defamatory comments, (vi) committing actions that might place minors in danger, (vii) publishing the personal data of other individuals or breaching privacy rights or (viii) usurping the identity of someone else.
17.3 In the event that the Content does not respect the applicable regulations in accordance with section 11.2 or, generally, if a User or a Visitor does not comply with these Terms and Conditions, the User or the Visitor recognises and accepts that he/she is solely responsible for the resulting direct and indirect losses of third parties or The Very Ting Ltd. Consequently, the User or the Visitor recognises and accepts that, in its capacity as hosting provider, The Very Ting Ltd., will under no circumstances undertake an verification of the Content and, to the extent permitted by applicable law, will under no circumstances be held responsible for such damages or losses suffered by Users and/or third parties.
In particular, without this list being exhaustive The Very Ting Ltd. will not be held responsible for: (i) actions or omissions of Users and Visitors, (ii) the information posted on the Website by Users and Visitors, their topics, their accuracy, their exhaustiveness and/or their compliance with the applicable regulations or (iii) the quality and quantity of Items Users sell or buy via the use of the Website, nor their compliance with the description given.
11.4 VINTED is not responsible for the Content uploaded online by Users. Users are responsible for their Content uploaded online.VINTED will remove User’s Content that has been duly notified to it in accordance with the procedure outlined in section 13 and with applicable laws and which is in violation of applicable laws and/or VINTED’s policies, that is all rules / regulations governing the use and operation of the Site. VINTED may take action against the User, in particular regarding the usability of his/her Account, as provided for in section 13 below. If any User or Visitor discovers Content condoning crimes against humanity ,inciting racial hatred and/or violence, concerning child pornography or any other unlawful content, VINTED must be informed immediately either by:
- applying the reporting procedure described here;
- sending an email to the address legal@vinted.co.uk;
- sending a letter outlining the underlying facts in detail to the following address: VINTED UAB, Švitrigailos g. 13, LT-03228 Vilnius, Lithuania.
If such Content is reported, VINTED will immediately, without notice, suspend the account of the User and the remove the Content concerned, as provided for in section 13 of the Terms and Conditions. VINTED will suspend the transactions under way while investigating the matter, which may result in VINTED in particular taking any of the actions stipulated in section 13.
If a User believes that some Content might violate these Terms and Conditions and/or their rights and/or the rights of a third party (e.g. counterfeiting, insult, breach of privacy rights), the Users may notify this to VINTED either by:
- applying the reporting procedure described here;
- sending an email to the address legal@vinted.co.uk;
- sending a letter outlining the underlying facts in detail to the following address: VINTED UAB, Švitrigailos g. 13, LT-03228 Vilnius, Lithuania;
- For Intellectual Property rights holders specifically, submitting a notice of Intellectual Property rights infringement by filling out the form available here.
If such Content is reported, VINTED may take action against the User, in particular regarding the usability of his/her Account, as provided for in section 13 below. More generally, Users will refrain from uploading any kind of Content that is unlawful, false or inaccurate. Users must act and use the Site in good faith.
11.5 In the event of a Transaction undertaken without the Integrated Payment and Shipping Service offered by VINTED, the Seller is responsible for the timely delivery of the Item in proper and due form to the Buyer, according to their agreement. In any event, if a dispute arises between the Buyer and the Seller regarding the delivery of the Item, the Seller must prove that the Item was dispatched (e.g. this may be in the form of a tracking number, an invoice or a document from the express delivery company).
11.6 In the event of a Transaction undertaken without the Integrated Payment and Shipping Service offered by VINTED, the Buyer is responsible for the timely payment of the Item, in accordance with the conditions communicated by the Seller or in accordance with the conditions agreed by mutual agreement.
11.7 In the event of a Transaction undertaken without the Integrated Payment and Shipping Service offered by VINTED, User understands and accepts that VINTED is not responsible for disputes occurring between Buyers and Sellers, will not provide assistance and will not be involved in their settlement. These disputes may be resolved in accordance with applicable local law, unless the parties have decided by mutual agreement that the laws of another country will apply.
11.8 The User is expressly reminded that the Internet is not a secure network. The User recognises that he/she is fully informed of the unreliability of the Internet, in particular in terms of potential security breaches regarding the transmission of data and of the absence of performance guarantees regarding the volume and speed of data transmissions. VINTEDdoes their best to keep the Site as secure as possible. Nevertheless, the Internet is not a secure network and the system reliability could be impaired independently of VINTED’s will.
11.9 VINTED cannot be held liable for unpredictable events such as cyber attacks security breaches regarding the transmission of data or for performance guarantees regarding the volume and speed of data transmissions. In these conditions, it is up to the Users to take all appropriate measures to protect their own data and/or software, particularly from contamination by any viruses circulating on the Internet
SECTION 17 – INDEMNIFICATION
You agree to indemnify, defend and hold harmless The Very Ting Ltd. and our subsidiaries, affiliates, partners, officers, directors, agents, contractors, licencors, service providers, subcontractors, suppliers, vendors, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 18 – SEVERABILITY
In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 19 – TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our Service(s), or when you cease using our site. The Very Ting Ltd. and the User agrees that in entering into these Terms have relied on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Terms or any document referred to in them. Neither The Very Ting Ltd. nor you shall have any claim for innocent or negligent misrepresentation based on any statement in these Terms or any document referred to in them.

These Terms and Conditions and any separate agreements whereby we provide you Service(s) shall be governed by and construed in accordance with the laws of Grenada.
